Digital Reserve Copyright Policy
DIGITAL RESERVE COPYRIGHT POLICYDigital reserve is a streaming media service made available for UMass Amherst classes requiring audio or visual reserves. All digital reserve files and online delivery must be in compliance with the Libraries’ copyright policy, and Title 17, Section 107, of the U.S. Copyright Law, Section 107(2) (the TEACH Act), and Section 108 (The Digital Millennium Copyright Act).
1. The digital reserve files are available only for the duration of the class for which they are intended. Access to them is provided through SPARK or the Libraries’ E-Reserves system.
2. Only faculty/staff/students teaching or enrolled in the UMass Amherst class will have access to digital reserve files, both on and off campus.
3. All material placed on digital reserve must be owned or licensed by the Libraries. The Libraries will make every effort to purchase the recording requested.
4. The instructor must fill out a Streaming Services Request Form. The forms are processed in the order in which they are received. Forms with complete information are processed first.
5. Please allow up to fourteen (14) days for the digital reserve files to be completed and available for listening.
6. Requests for digital reserves must be made for each semester that the material is needed.
7. Digital reserve files may be made only of works that are an integral part of the course curriculum as required by the instructor.
8. Digital reserve files will be removed at the completion of the course.
9. Faculty, staff and students may not copy, redistribute, modify, and/or archive any of the digital reserve files streamed for course use.
10. Under the provisions of the Digital Millennium Copyright Act the Library may not circumvent technological controls (such as anti-piracy encryption of DVDs) that a copyright owner applies to a work that prevent retention and distribution.
11. The Library reserves the right to reject any requests not in compliance with the Libraries’ Copyright Policy.
